Please read these terms before using DeficitAI. By creating an account you agree to them. If you do not agree, do not use the app.

1. Who we are

DeficitAI ("the app", "we", "us") is operated by mixis, Timo Flloko, Kosovo. You can reach us at suhejbmorina@gmail.com.

2. What DeficitAI is, and what it is not

DeficitAI is a general wellness and self-tracking tool. It helps you record what you eat, estimate calories and macronutrients, and follow a calorie target you choose.

DeficitAI is not:

• a medical device;
• a source of medical, nutritional, or dietetic advice;
• a diagnostic tool;
• a substitute for a doctor, dietitian, or other qualified professional.

Nothing in the app, including any figure, target, chart, notification, badge, or message from the in-app coach is medical advice, and none of it should be treated as a professional recommendation about your health.

Always consult a qualified healthcare professional before starting any weight-loss plan, changing your diet, or acting on anything you read in the app, particularly if you have or suspect any medical condition, take medication, are pregnant or breastfeeding, or have any history of disordered eating.

If you believe you may be experiencing a medical emergency, contact your local emergency services immediately. Do not rely on the app.

3. Who may use the app

You may use DeficitAI only if you are 18 or older and legally able to enter into these terms.

The app is not intended for:

• anyone under 18;
• anyone pregnant or breastfeeding, unless a healthcare professional has advised it and is supervising them;
• anyone with a current or past eating disorder, or at risk of one;
• anyone whose doctor has advised against calorie restriction or self-directed dieting.

If any of these apply to you, please speak to a healthcare professional rather than relying on this app.

4. Estimates, not measurements

Every nutritional figure in DeficitAI is an estimate, and estimates are often wrong. Specifically:

Calorie and macronutrient targets come from standard published equations applied to the details you enter. Those equations are population averages. Individual energy needs vary substantially, and your real requirements may differ from what the app calculates.

Food database entries come from third-party sources including Open Food Facts (crowd-contributed) and USDA FoodData Central. We do not verify this data. It may be incomplete, out of date, or simply wrong.

Photo analysis uses an automated model to estimate what a meal contains and how large the portion is, from a single flat image. This is inherently imprecise particularly portion size, and will sometimes be substantially wrong. Always review and correct the figures before saving them.

The in-app coach produces automatically generated text. It can be inaccurate or inappropriate for your situation, and it is not a professional.

Projections and timelines including estimated dates for reaching a goal weight, are illustrative only. They are not predictions, promises, or guarantees of any result.

We do not warrant that any figure in the app is accurate, complete, or suitable for you.

5. Your responsibility

You use DeficitAI at your own risk and on your own judgement.

You are responsible for:

• the accuracy of what you enter;
• reviewing and correcting any figure before relying on it;
• every decision you make about what you eat, how much you eat, and how you train;
• deciding whether the app's targets are appropriate for you, ideally with a healthcare professional;
• stopping use of the app and seeking professional help if you feel unwell, if your relationship with food or your body becomes distressing, or if anything about your use of the app concerns you.

Do not use the app to restrict your intake below the targets it sets. Those targets already include minimum safety floors, and eating below them without medical supervision can be harmful.

6. Your account

You are responsible for keeping your sign-in credentials secure and for everything that happens under your account.

You may delete your account at any time from within the app. Deletion is permanent and removes your profile, food diary, weight history, and plan. We cannot recover deleted data.

We may suspend or terminate an account that breaches these terms.

7. Acceptable use

You agree not to:

• use the app for any unlawful purpose;
• attempt to access another user's data;
• reverse engineer, scrape, or overload the app or its backend services;
• resell or redistribute data obtained through the app;
• use automated means to generate excessive requests to any feature.

We apply usage limits to some features and may change those limits at any time.

8. Third-party services

DeficitAI relies on services operated by others, including authentication and database providers, an automated model provider used for photo analysis and the coach, and third-party nutrition databases. How they handle data is described in our Privacy Policy.

We are not responsible for the availability, accuracy, or conduct of third-party services.

9. Availability

We provide the app "as is" and "as available". We do not guarantee it will be uninterrupted, error-free, or available at any particular time. Features may change, be limited, or be removed.

To the fullest extent permitted by law, we exclude all warranties not expressly stated in these terms.

10. Limitation of liability

To the fullest extent permitted by applicable law:

• we are not liable for any loss or damage arising from your use of, or inability to use, the app;
• we are not liable for decisions you make about your diet, health, or training, whether or not those decisions were informed by the app;
• we are not liable for the inaccuracy of any nutritional figure, estimate, projection, or automatically generated message;
• we are not liable for indirect or consequential loss, or for loss of data, profit, or opportunity.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, for fraud, or for any other liability applicable law does not permit us to exclude.

Where liability can be limited, our total liability to you is limited to the greater of the amount you paid us in the twelve months before the claim, or $30.

11. Changes to these terms

We may update these terms. If a change is material we will tell you in the app or by email before it takes effect. Continuing to use the app after a change means you accept the updated terms.

12. Governing law

These Terms and your use of DeficitAI are governed and interpreted in accordance with the laws of the Republic of Kosovo, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms or your use of DeficitAI shall be subject to the jurisdiction of the competent courts of the Republic of Kosovo.
